    1. General
    The following terms and conditions apply to all orders placed by the customer (hereinafter referred to as ”you”) with MONKI through H & M Hennes & Mauritz GBC AB, hereinafter referred to as “MONKI”, ”us ” or ”we”, at the MONKI website, and mobile website, (jointly referred to as ”MONKI”).

    By using MONKI and/or placing an order, you agree to be bound by the terms and conditions set out herein (the ”Terms”). Please make sure you have read and understood the Terms before placing your order.

    Only persons of legal age, 18 years or older, who are not under guardianship, and are not acting in capacity as a company, with a physical address in one of the markets that MONKI provides deliveries to, can place an order.     The inclusion of any products or services at MONKI at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product at any time. We do our best to ensure that information on monki.com is complete, accurate and current. Despite our efforts, however, information on monki.com may occasionally be inaccurate, incomplete or out of date. All specifications, products, descriptions and prices of products at monki.com are subject to change at any time without notice.

    We reserve the right to amend these Terms from time to time without prior notice to you. The version of the Terms that will apply to your order will be those at monki.com at the time you place your order.

You understand and agree not to (i) post, transmit, redistribute, upload, or promote any communications or content that could harm or negatively impact our business, products or services; (ii) act in a manner or employ any device that restricts, impairs, interferes or inhibits any other user from using or enjoying the monki.com site, or which impacts the security of the site, or (iii) employ any device or attempt to use any engine, software, tool, agent, script or other device or mechanism (including without limitation spiders, bots, crawlers, avatars or intelligent agents) to navigate or search the site, or to copy content from the site.     2. Prices and delivery charges

    Please note that the prices on monki.com do not include local sales tax or VAT. If local taxes are to be borne by you, it will be presented in the checkout. If the value of your order exceeds the toll-free limit in your market, extra fees might be applied for import taxes and custom duties upon delivery. Monki does not compensate these charges. You can check with your local Customs Office or UPS for more information.

    The delivery charge for each order will be the same, regardless of the size or weight of your order. The total cost of the order, excluding local sales tax/vat and import duties, including cost for the delivery method you choose is clearly indicated during the check-out process. If we are unable to deliver your order in full and have to make more than one delivery, there will not be an additional charge for any subsequent deliveries. Prices in store and online may vary.

    3. Ordering/conclusion of contract
    Orders can be placed via monki.com only. Please visit our Customer service pages for further information.

    Once you have placed your order, you will receive an email confirmation that we have received your purchase request. If for any reason we are unable to fulfill your request/order, we will let you know at the earliest opportunity. Although we aim to keep our site up to date and free from errors, we may from time to time have technical issues with the site resulting in the display of incorrect information (such as availability and price). Due to this we reserve the right to cancel your order, or part of your order, from the time you have received your order confirmation email until the time the order is dispatched from our warehouse and you receive a shipping confirmation email from us. If we have already received payment for such order, we will attempt to refund the applicable amount using the same method used to make the payment. If, for any reason, alternative arrangements are necessary we will notify you and ask you to contact MONKI Customer Service who will settle the refund.

    Any order must total at least 5 USD (after deduction of discounts) in order to be processed.

    4. Delivery
    MONKI exercises the utmost diligence in accepting and processing orders and will endeavour to deliver your order in accordance with your selected delivery option.

    MONKI endeavours to dispatch orders in the fastest possible time and in the order in which they are placed. Though we aim to deliver within the communicated time frame, delivery may take longer due to unexpected events. In the unlikely event the delivery time exceeds 30 days, you may cancel your order.

    Before you place your order, you will be informed of the expected delivery details. Once you have placed your order you will receive an email confirmation with your expected delivery details. You will find the full Delivery policy at monki.com.

    5. Withdrawal of Order
    You may cancel your order from the date you receive your order until 30 days after receipt of the ordered items, by returning the items or order to us. If you have been charged for the items, you will receive a refund which will include the standard delivery cost. Please note that MONKI will not refund any applicable customs duties or sales tax. Should you choose to keep certain items and only partially cancel your order, the delivery cost will not be refunded. Please note that you will bear the cost of the return, unless the item is faulty.     If you wish to cancel your order, please follow the instructions on our Return pages on monki.com and return the item(s) to us as set out in section 6 (Returns) below within the 30 day period set forth in section above. If you choose to arrange the return in an alternative way, please contact customerservice.international@monki.com.

    We will provide a refund attempting to use the same method used to make the payment as soon as possible and at the latest within 14 days of receiving the items in our warehouse, or evidence of you having sent back the items. Another payment method may be used for the refund, provided that you consent to such a change; in any case this will not generate any additional charges. Read more on our Return pages at monki.com.

    If the item you have received is defective, please notify MONKI promptly and return the item in accordance with section 6 (Returns) below. MONKI will, for any products deemed defective, provide a full refund, including the costs of delivery, unless you keep other items in the order, and costs of the return. The provisions set forth herein do not limit any applicable statutory rights.

    In the event of an error in connection with any products or services displayed through monki.com (including typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, and availability), MONKI reserves the right to cancel any order prior to the time it is delivered to you.

    6. Returns
    MONKI guarantees a full refund for any returned items in accordance with section 5 (Withdrawal of Order), provided that all items are returned in the same condition they were in upon your receipt. This means the items should not have been damaged, soiled, washed, altered or worn (other than to try the item on) and that any labels or tags should be intact. MONKI holds the right to determine the state of the returned item and decide on the refund.

    7. Payment methods
    You can pay for your goods in various ways as set out below.

    Paypal
    When paying by PayPal, MONKI reserves the right to check the validity of the PayPal account, that there are enough funds to cover the purchase sum and validate the billing address details of the purchaser. The applicable amount will immediately be reserved on your PayPal account but will not be debited until the goods are dispatched from the warehouse. MONKI reserves the right to deny any purchase.

    Klarna
    PAY NOW – You can pay using a VISA or Mastercard in any of our shipping locations. Payment will be taken from your bank account when your order is dispatched. Please note that Klarna’s Terms and Conditions and Privacy Policy, as communicated in the check out, applies to the payment.

    Others
    You are obliged to submit a correct e-mail address and to inform MONKI if your e-mail address changes. Please note that MONKI reserves the right to send payment requests to your e-mail address.

    Please note that we are unable to accept gift cards, cash and merchandise cards as forms of payments via MONKI.

    You will receive the receipt in the shipping confirmation e-mail, which is sent to you when your order is dispatched from our warehouse.

    8. Our Liability
    Nothing in these Terms shall exclude or limit MONKI's liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.

    We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents. If we breach these Terms, we shall only be liable for losses which are a reasonably foreseeable consequence of such breach.

    MONKI is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control i.e. Force Majeure.

    Our maximum liability to you for any loss or damage arising in connection with your order at MONKI shall be limited to the total price of your order.

    9. Colours
    We make all reasonable efforts to accurately display the attributes of our products, including composition and colors. The color you see will depend on your computer system, and we cannot guarantee that your computer will accurately display such colors.

    An item’s measurements given at monki.com are only approximate values to give you a better understanding of the model or fit of that specific item, and not a definite guarantee of the actual measurements of the item you receive. The final measurements of an item may vary depending on the material used in its production.

    10. Guarantee
    If there are defects in the goods you have purchased, MONKI abides by all statutory guarantee regulations. If you have a complaint regarding obvious material or manufacturing faults in goods that we have supplied, including damage incurred in transit, please let us know by returning the goods to us without delay.

    11. Assignment
    MONKI reserves the right to assign or pledge to third parties any claim(s) for payment which have arisen in connection with the delivery of goods.  

    12. Severance
    If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other Terms shall continue to apply.

    13. Ownership of rights
    All intellectual property rights, such as trademarks and copyrights at MONKI remain with H&M Hennes & Mauritz AB and its subsidiaries or licensors. Any use of MONKI or its contents, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of MONKI.

    Returning at any Monki store the same market you made the purchase is free of charge.

    However, from 17th of October, returns via pick-up point/post have a cost of 30 SEK that will be deducted from the total refunded amount. Meaning that if you return your parcel on the 17th of October and onwards, you will be charged a 30 SEK return fee.

    All our parcels contain a pre-printed return form for you to use if you decide to return any items. Read more about it on our  Return & refund page.

    7. Payment methods
    You can pay for your goods in various ways as set out below.

    Klarna
    PAY NOW – You can pay using a VISA, Mastercard or AMEX card in any of our shipping locations. If you reside in SE, DE, AT or NL, you may also choose to shop using other direct banking options which will also be available at check out. Payment will be taken from your bank account as soon as your order is confirmed.

    PAY LATER – Customers can choose to buy now and pay later. This option will be shown to you at checkout depending on your eligibility. If you are not eligible you will still see Pay Now options. You will receive information on how and when to pay when your order has been dispatched.

    SLICE IT – Customers can choose to open an account with Klarna and receive monthly statements based on the option you chose. This option will be shown at checkout depending on your eligibility.     The delivery charge for each order will be the same, regardless of the size or weight of your order. The cost for each delivery method is clearly indicated during the check-out process. If we are unable to deliver your order in full and have to make more than one delivery, there will not be an additional charge for any subsequent deliveries. Prices in store and online may vary.

    3. Ordering/conclusion of contract

    Once you have placed your order, if you have supplied us with your email address, you will receive an email confirmation. If for any reason we are unable to fulfil your order, we will let you know at the earliest opportunity. If we have already received payment for such order, we will attempt to refund the applicable amount using the same method used to make the payment. If, for any reason, alternative arrangements are necessary we will notify you and ask you to contact Monki Customer Service who will settle the refund.

    Any order must total at least 5 EUR (after deduction of discounts) in order to be processed. Except Denmark, 35 DKK.

    4. Delivery
    Monki exercises the utmost diligence in accepting and processing orders and will endeavour to deliver your order in accordance with your selected delivery option.

    Monki endeavours to dispatch orders in the fastest possible time and in the order in which they are placed. Though we aim to deliver within the communicated time frame, delivery may take longer due to unexpected events. In the unlikely event the delivery time exceeds 30 days, you may cancel your order.

    Before you place your order, you will be informed of the expected delivery details. Once you have placed your order you will receive an email confirmation with your expected delivery details. Read more about it under  Payment & delivery.

    5. Withdrawal of Order

    If you wish to cancel or return your order, please provide us with notice in writing either via email to customerservice@monki.com, or by post, preferably by using the pre-printed return form in your parcel; or by sending a letter to Monki Customer Service, PO Box 24005, EDINBURGH, EH1 9AG, U.K. and return the item(s) to us as set out in section 6 (Returns) below within the 30-dayperiod set forth in section 5.1 above. We will provide a refund attempting to use the same method used to make the payment (or, if the items have not yet been paid for, reflect the return of the items in your account balance) as soon as possible and at the latest within 14 days of receiving your notice of cancellation, provided we have received the items or evidence of you having sent back the faulty items. Another payment method may be used for the refund, provided that you consent to such a change; in any case this will not generate any additional charges.     If the item you have received is defective, please notify Monki promptly and return the item in accordance with section 6 (Returns) below. Monki will, for any products deemed defective, provide a full refund, including the costs of delivery and return. The provisions set forth herein do not limit any applicable statutory rights.

    In the event of an error in connection with any products or services displayed through monki.com (including typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, and availability), Monki reserves the right to cancel any order prior to the time it is delivered to you.

    6. Returns

    All returns via pick-up point/post have a cost of €3 / 30 DKK that will be deducted from the total refunded amount, for any returned items in accordance with section 5 (Withdrawal of Order), provided that all items are returned in the same condition as they were when you received them. This means the items should not have been damaged, soiled, washed, altered or worn (other than to try the item on) and that any labels or tags should be intact.

    All our parcels contain a pre-printed return form for you to use if you decide to return any items. Drop off your items to be returned at a post office or pick-up point location as described on your return form. Read more about it on our  Return & refund page.

    7. Payment methods

    You can pay for your goods in various ways as set out below.

    Klarna
    PAY NOW – You can pay using a VISA, Mastercard or AMEX card in any of our shipping locations. If you reside in SE, DE, AT or NL, you may also choose to shop using other direct banking options which will also be available at check out. Payment will be taken from your bank account as soon as your order is confirmed.

    *Please note that Monki cannot provide details of why you are not be eligible to pay using our Pay Later or Slice It options. If you have any questions regarding payment, please contact Klarna customer support.

    PayPal
    When paying by PayPal, Monki reserves the right to check the validity of the PayPal account, that there are enough funds to cover the purchase sum and validate the billing address details of the purchaser. The applicable amount will immediately be reserved on your PayPal account but will not be debited until the goods are dispatched from the warehouse. Monki reserves the right to deny any purchase.

    Others
    You are obliged to submit a correct e-mail address and to inform Monki if your e-mail address changes. Please note that Monki reserves the right to send payment requests to your e-mail address.

    Please note that we are unable to accept gift cards and merchandise cards as forms of payments via monki.com

    You will receive the legally required invoice in the shipping confirmation e-mail.

    8. Our Liability
    Nothing in these Terms shall exclude or limit Monki's liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.

    We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents. If we breach these Terms, we shall only be liable for losses which are a reasonably foreseeable consequence of such breach.

    Monki is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity.

    Our maximum liability to you for any loss or damage arising in connection with your order on monki.com shall be limited to the total price of your order.

    9. Colours
    We make all reasonable efforts to accurately display the attributes of our products, including composition and colours. The colour you see will depend on your computer system, and we cannot guarantee that your computer will accurately display such colours.

    10. Guarantee
    If there are defects in the goods you have purchased, Monki abides by all statutory guarantee regulations. If you have a complaint regarding obvious material or manufacturing faults in goods that we have supplied, including damage incurred in transit, please let us know by returning the goods to us without delay by using the provided pre-printed return form.

    11. Assignment
    Monki reserves the right to assign or pledge to third parties any claim(s) for payment which have arisen in connection with the delivery of goods.  

    12. Severance
    If any part of these Terms is disallowed or found to be ineffective by any court or regulator, the other Terms shall continue to apply.

    13. Ownership of rights
    All intellectual property rights, such as trademarks and copyrights at monki.com remain with H&M Hennes & Mauritz AB and its subsidiaries or licensors. Any use of monki.com or its contents, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of Monki.

    1. INTRODUCTION
    1.1. These terms and conditions (the “Terms”) are applicable when you sign up as a member on monki.com or community.monki.com (the "Membership") and use the features and content on the websites enabled by the Membership. Unless otherwise stated in any additional terms, the Membership is provided by H&M Hennes & Mauritz GBC AB, org.no. 556070-1715, with its registered office on Mäster Samuelsgatan 46 A, 106 38 Stockholm, Sweden (“we,” “us” or “Monki”). By signing up for a Membership you agree to be bound by these Terms.  

    1.2. We reserve the right to make amendments to these Terms from time to time without prior notice. If such amendments will materially affect your Membership negatively, we will send a prior notification via email. If you do not agree to the amendments you may terminate the Membership. Please make sure to stay updated on these Terms. You will always find the latest version of these Terms here.

    2. THE MEMBERSHIP

    2.1. A Membership will allow you access to certain membership-features on monki.com ("Monki Website"), as well as access to certain membership-features on community.monki.com ("Monki Community") provided that you select a personal nickname. If you sign up for a Membership and do not select a personal nickname, the Membership will only grant you access to certain membership-features on Monki Website.

    2.2. To sign up for a Membership you must be at least 18 years old, or 16 years old and have the consent of a parent, guardian, or legal representative as applicable. We reserve the right to request written confirmation of such consent. You also need to provide us with a valid email address. You warrant that that you are the owner of your registered email address. Please note that we only allow one (1) Membership per person and registered email address. The Membership is limited to individuals that are acting in a personal capacity and not in the capacity of a company. Employees, officers, directors, agents and representatives of Monki are eligible for Membership but may be excluded from certain promotions. The Membership is personal and non-transferable.

    2.3. Your Membership will remain active until terminated by either you or Monki. You may terminate your Membership at any time, and for any reason by contacting Customer Service on customerservice@monki.com. Please note that terminating the Membership means that your access to the membership-features on Monki Website and the membership-features on Monki Community will cease immediately, and that you will only be able to shop using the guest checkout on Monki Website.

    2.4. We reserve the right to at any time and in our sole discretion modify, add to, suspend or terminate the Membership and/or the membership-features on Monki Website and Monki Community (the "Services") without prior notice to you. Any new or modified Services are subject to these Terms.

    2.5. To keep your Membership safe, make sure that you keep Membership information, including information of login details, confidential. You are responsible for all activity that is conducted through your Membership. You are obligated to immediately report lost or stolen login details to our Customer Service, as well as if you believe someone has used your Membership without authorization.

    2.6. If we in our sole discretion determine that you have breached these Terms, we may suspend or terminate your Membership without any prior notice to you, and we reserve the right to refuse or terminate any new Membership's you are found to possess or attempt to register in the future.

    2.7. When using your Membership, it is prohibited to engage in any illegal, harmful or inappropriate activity. Furthermore, you understand and agree not to (i) post, transmit, redistribute, upload, or promote any communications or content that could harm or negatively impact our business, products or services; (ii) act in a manner or employ any device that restricts, impairs, interferes or inhibits any other user from using or enjoying the Membership, Monki Website or Monki Community, or which impacts the security thereof, or (iii) employ any device or attempt to use any engine, software, tool, agent or other device or mechanism (including without limitation spiders, bots, crawlers, avatars or intelligent agents) to navigate or search Monki Website or Monki Community, or to copy content therefrom.

    3. MONKI WEBSITE AND MONKI COMMUNITY

    3.1. On Monki Website you will, by signing up for a Membership, be able to access certain membership-features as described on the Monki Website from time to time, such as the possibility to access an overview of your orders made online. As a member we will give you a tailor-made experience of Monki including but not limited to personalized offers and treats.

    3.2. On Monki Community you will, by signing up for a Membership, be able to access certain membership-features as described on Monki Community from time to time provided that you select a personal nickname. Your selected nickname will be displayed on a personal profile page, as well as if you chose to use any community features such as, but not limited to, joining conversations in chatrooms or sharing content.

    3.3. The Monki Sites may allow you to engage in conversations with other members and to post comments. When engaging in such conversations and/or posting of comments, you agree to be courteous and respectful, and to refrain from posting any illegal, harmful, inappropriate or commercial messages. This includes but is not limited to refraining from posting discriminating messages about age, disability, ethnicity, origin, political belief, race, religion, gender or sexual orientation, as well as promoting your business or artistic enterprise, and/or impersonate another.

    3.4. Unless otherwise noted, the Monki Website and Monki Community (collectively "Monki Sites"), including the software, source code, trademarks, text, images and/or any other content and materials that are part thereof and/or thereon provided by Monki or any of its subcontractors (collectively “Monki Content”), is the sole intellectual property of Monki. Monki Content is intended solely for your personal and non-commercial use. No right, title or interest in any Monki Content or any intellectual property rights generated therefrom is granted or transferred to you as a result of your use of Monki Sites, Monki Content or the Membership. 

    3.5. The Monki Sites may give you the option to upload text, files, images, photos, videos, sounds or other materials (collectively "Your Content"). We do not claim any ownership rights in Your Content, subject to the limitations below in clause 3.6. By uploading Your Content, you grant to Monki a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, fully paid, sublicensable and transferable license to use, modify, reproduce, distribute, prepare derivative works of, display, perform, translate and otherwise fully exploit Your Content, including without limitation distributing part or all of the Monki Sites in any media formats through any media channels. In essence this means, inter alia, that Your Content may be used by us at our discretion, irrespective of the termination of your Membership. However, if you terminate your Membership we will not continue to use Your Content holding personally identifiable information. In such case we will either (a) remove personally identifiable indictors or (b) delete such Your Content, which ever we deem suitable. By uploading Your Content you represent and warrant that: (i) you own Your Content or otherwise have the right to grant the license set forth in this section, (ii) the uploading and use of Your Content on the Monki Sites does not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights or any other rights of any natural or legal person, and (iii) the uploading of Your Content does not result in a breach of contract between you and a third party.

    3.6. You agree that any copyright and/or other intellectual property created by you through the use of Monki Content, such as but not limited to creating looks and "outfit of the day", will be transferred to Monki in entirety and irrevocably without any legal limitation(s). The compilation of Monki Content, included in or made available through the Monki Sites, is the exclusive intellectual property of Monki and protected by applicable laws.

    3.7. The Monki Sites may allow you to share Monki Content on social media platforms. These features grant you a limited, non-exclusive, license to display such Monki Content as directed, and you understand that you have no other right, title or interest in or to such Monki Content.  

    4. DATA AND COMMUNICATION

    4.1. You can find information about how Monki will process personal data when signing up for a Membership and using the Monki Website and Monki Community in the Privacy Notice.

    4.2. By signing up for a Membership you agree to receive communications by e-mail regarding activity linked to your Membership, such as but not limited to confirmation of the creation of the Membership and notifications regarding unread messages. To stop receiving such communications by e-mail you may follow the opt-out instructions in the specific e-mail. You also agree to receive service messages by e-mail, such as but not limited to potential changes in these Terms, which you cannot opt-out from receiving unless terminating your Membership. As for communications by e-mail regarding offers, promotions or other marketing, we will request a separate consent from you in the sign up process. Please note that you will not be able to receive any offers or promotions by e-mail granted to you through the Membership unless you consent to receiving such communication in the sign up process or by changing your settings under "My Account".”

    5. LINK TO THIRD PARTY VENDORS

    5.1. The Monki Sites may include links to other websites maintained by third parties. These links are provided to you solely as a convenience, and the inclusion of these links to third party websites does not imply endorsement by us of the content or materials on these websites. Your access to these third party websites is at your own risk and we will have no liability arising out of or related to such websites or your access to or use of such websites.

    5.2. Any vendor that may from time to time be referred to by us is an independent contractor. We do not have any commercial relation with the vendors. Any commercial, or other, relation that you chose to enter into with anyone of the vendors that we at times may link to on the Monki Sites, is goverened by that vendor's relevant terms and conditions and privacy policies. We do not assume any liability for purchases of services or products, or the processing of personal data that results from your interaction with the relevant vendor.

    6. LIABILITY

    6.1. Although member messages and uploaded Your Content may be posted on the Monki Sites through for example but not limited to chat rooms and message boards, the postings does not constitute our endorsement of such member messages or Your Content. We are not responsible or liable for any claim, loss or damage in connection with such member messages or uploaded Your Content. We reserve the right but no obligation to in our sole discretion remove any member messages or uploaded Your Content that we deem to be in violation of these Terms or applicable laws.

    6.2. You agree that your use of the Monki Sites, including the use of chat rooms and message boards, is at your own risk and discretion, and that you are solely responsible for any actions you take on the Monki Sites, including any messages you post and uploaded Your Content. You also agree that you are solely responsible for any and all actions that you take based on information gained on the Monki Sites. You warrant to indemnify us for all royalties, fees, and any other monies owing to any natural or legal person by posting messages or uploading Your Content that violates any laws and regulations or any third party intellectual property rights.

    6.3. We do not warrant that access to the Membership or the Monki Sites will be delivered uninterrupted, timely, secure, or error-free. Technical support is provided on a best-effort basis by our Customer Service. If you experience any issues, please email us at customerservice@monki.com.

    6.4. We do our best to ensure that the information we provide on the Monki Sites are complete, accurate and current. Despite our efforts information on the Monki Sites may occasionally be inaccurate, incomplete or out of date. We do not warrant the accuracy or completeness of the information, content or materials provided on the Monki Sites. 

    6.5. If H&M is found in breach of these Terms, H&M shall only be liable for losses which are a reasonably foreseeable consequence of such breach. In no event shall H&M be liable for any failure or delay in the performance of its obligations hereunder arising out of or caused by directly or indirectly forces beyond its control, including without limitation to fire, flood, storm, riot, civil disturbance, war, nuclear accident, epidemic, pandemic, virus, and terrorist activity. In no circumstances will H&M be liable for any loss of profit, loss of revenue or for any indirect or consequential loss arising out of a breach of these Terms or otherwise in connection with these Terms.

    6.6. Nothing in these Terms shall exclude or limit Monki's liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.

    7. SEVERENCE

    If any clause or part thereof in these Terms is found to be unenforceable for any reason, such unenforceability will not affect the enforceability of the remaining part of the clause or any other clauses in these Terms.

    8. APPLICABLE LAW AND JURISDICTION

    These Terms are governed, interpreted and applied in accordance with the laws of Sweden, and any dispute, claim or controversy arising from or relating to these Terms shall be resolved by the general courts of Sweden. However, if you are a resident of another country or region than Sweden, these Terms can be subject to mandatory consumer protection laws and regulations in force in your country or region of residence which may provide you additional rights.

    9. Complaints and dispute resolution

    9.1. If you have any questions or complaints regarding your Membership or the Monki Sites you may contact Monki's Customer Service on customerservice@monki.com.

    9.2. We adhere to applicable local dispute resolution regulations by competent authorities for the settlement of potential customer complaints. You may file possible complaints to the EU’s online dispute resolution platform (the “ODR platform”). The ODR platform offers consumers and traders within the EU with the possibility to try and reach an out-of-court settlement for complaints arising from online purchases. This single entry point is designed to be a user-friendly and interactive website, available in all EU official languages and free of charge. Using the ODR platform the consumer and the trader can find a dispute resolution body and then go through the process of finding a solution to the consumer’s complaint.     By entering a customer review through the Customer Rate and Review service for any of our products You grant Monki, through H & M Hennes & Mauritz GBC AB [556070-1715], hereinafter referred to as “Monki” a non-exclusive, royalty free worldwide license to use any of your written reviews in relation to its marketing and/or in its advertising, including without limitation, in the online store, in newsletters, email and other customer communications, store materials and other marketing purposes.

    You hereby release and discharge Monki from all and any obligation to pay you for any use of your texts and any of the copy rights contained therein in connection with the uses described above; and You hereby release, discharge and agree to hold Monki and any person acting on Monki's behalf harmless from all claims, demands, and liabilities whatsoever in connection with use of the customer reviews as described above.

    Monki reserve the right to amend these Terms from time to time without prior notice, however the Terms that was available to you on monki.com at the time of submitting the review will apply for that review.
