By responding to our request with the hashtag #monkistyle you agree to the following:
You grant H & M Hennes & Mauritz GBC AB (org. no 556070-1715) (hereinafter referred to as “Monki”) a non-exclusive, royalty free worldwide license to use your username and any photos and/or moving content in relation to which you have responded #monkistyle (hereinafter referred to as “Content”) for marketing and/or advertising in stores, on websites, emails, social media – Monki channels and paid social media, and other promotional channels, conducted by Monki, its subsidiaries, affiliates or partners. This includes other brands within the H&M Group, as well as other external parties outside the H&M Group which Monki collaborates with, like for example marketplaces. Monki may use, reproduce, distribute, combine with other materials, alter and/or edit your Content in its sole discretion.
You hereby represent and warrant that (i) you own all rights in and to your Content, (ii) you have permission from any person(s) appearing in your Content to grant the rights herein, (iii) you are 16 years or older, and (iv) Monki’s use of your Content will not violate the rights of any third party or any law. You hereby release and discharge Monki from all and any obligation to pay you for any use of your Content and any of the intellectual property rights contained therein in connection with the uses described above; and You hereby release, discharge and agree to hold Monki and any person acting on Monki’s behalf harmless from all claims, demands, and liabilities whatsoever in connection with use of the Content as described above.

Why do we use your personal data?
We want to share and inspire the ways of wearing Monki products for marketing purposes and to give you the chance to show the world your Monki style.
How do we use your personal data?
We will use your personal data (photo, video, username) for marketing and/or advertising in stores, on websites, emails, social media channels and paid social media, and other promotional channels, conducted by Monki. This includes other brands within the H&M Group, as well as other external parties outside the H&M Group which Monki collaborates with, like for example marketplaces. To be able to do this we need your photo and/or video and in return we will link your photo and/or video to your Instagram account.

Who has access to your personal data?
Your data may be shared within H&M Group and with selected social media platform providers. The photos and/or videos you submit to us are also forwarded to media agencies and technical suppliers carrying out certain tasks on our behalf.
Please note, by hash-tagging your picture or video clip you voluntarily share the content and other personal data with Instagram or other social media platforms. This relationship is outside of H&M's control and a matter between you and the social media service provider.
What is the legal ground to process your personal data?
We will collect, use, and share your username, photos and/or videos to the extent necessary for us to perform the service and meet your expectations when using the #yesMonki service (fulfillment of contract).
How long do we keep your data?
We will use your username, photo and/or video for 24 months or until the #Monkispecific agreement is terminated.
